If you do not have a valid power of attorney an expensive court guardianship will be required if you become in any way incapacitated. 1. “My Dad had a Will so no probate is required.” Wrong: a Will has important functions, including naming beneficiaries and the personal representative, but if the decedent died with FL assets in his sole name then a probate is required to get those assets out of his estate.
2. “If you do not have a Will the state will get everything.” Wrong: FL law will determine who gets the assets in an intestate estate, which will depend upon who survives the decedent (in order of preference, surviving spouse, then children, then grandchildren, then parents, then siblings, and so on), but FL does not receive the assets.
3. “The FL real estate has already been dealt with in the New York probate.” Wrong: an out-of-state probate has no jurisdiction over FL real estate. Despite the NY probate a FL probate will be required to distribute the FL real estate.
